On aime à penser que le propre de l'être humain est d'être doté d'une raison dont il use pour élargir le champ de ses connaissances, maîtriser ses pulsions animales et égoïstes - qu'il les transcende dans la création artistique (qu'elle soit littéraire, musicale, plastique, théâtrale, culinaire ou potagère...) la pensée, la solidarité, la générosité, l'altruisme voire la méditation.
A deux jours du Vday, les informations trouvées dans ma bal ce matin - alors que les radios ne parlent que de la retraite bien méritée d'un vieil homme qui reconnaît ses faiblesses (il y en a beaucoup qui pourraient suivre cet exemple), me mettent très en colère. J'hésitais à parler de la première quand la seconde est venue redonner à ces actes un dénominateur commun : une barbarie toute masculine, celle de pères qui l'ont exercée sur leurs fillettes en les violant. L'un est imam en Arabie Saoudite, l'autre un français vivant en Inde. Dans les deux cas ces hommes ignobles sont protégés par leur gouvernement et des bâtons mis dans les roues d'une justice qui peine à être rendue. Si les femmes étaient davantage présentes dans les instances décisionnelles, ce qui peut apparaître comme un népotisme masculiniste serait peut-être moins arrogant !
Après la polémique créée la semaine dernière par Marcel Rufo qui minimisait les conséquences des incestes avec tous les relais médiatiques voulus, je crois important de porter ces deux actes de barbarie avérés à la connaissance du plus grand nombre.

Les révolutions et les mouvements politiques appelant au changement ne se produisent pas spontanément. Ils sont déclenchés par l'étincelle d'un évènement dramatique. Il est possible qu'en Arabie saoudite, cette étincelle se soit allumée.
Les nouvelles annoncent que le prêcheur Fayhan al-Ghamdi a admis avoir torturé et tué sa fille de 5 ans, Lama. Et le tribunal l'a laissé sortir libre. Il a même obtenu la charge de ses deux autres enfants…
Aujourd'hui les activistes prennent position. Al Ghamdi est un prêcheur extrémiste qui apparaît souvent à la télévision. Il a d'abord été accusé d'avoir abusé de sa fille en Avril 2012. Le viol était si violent que la fille a souffert d'une fracture du crâne et d'une lésion au cerveau. Malgré cela, personne ne l'a empêché d'avoir accès à elle, ce qui a entraîné sa mort en décembre.
Al Ghamdi a été arrêté après le décès de sa fille et a admis sa responsabilité, disant qu'il l'avait assaillie, car il suspectait qu'"elle avait déjà perdu sa virginité"…! (à 5 ans).
Une assistante sociale a précisé que Lama avait été violée "partout", mais sa mère a dit qu'une partie de l'histoire était fausse. Lama a reçu des chocs électriques, a été battue avec un fouet et une barre de fer. Son crâne a été écrasé. Son dos et ses bras étaient brisés. Ses côtes étaient fêlées. A l'hôpital on a même dit qu'al Ghamdi a tenté de brûler son rectum pour le souder…
Un membre de la Commission des Droits de l'Homme du gouvernement saoudien a dit à CNN qu'al Ghamdi a fait 8 mois de prison pour avoir torturé sa fille jusqu'à sa mort, laissant entendre qu'il était encore en prison. CNN n'a pas à réussi à joindre un quelconque activiste, ni aucun officiel, ni même l'hôpital du roi Saoud.
Le juge saoudien a estimé que le court séjour d'al Ghamdi en prison était une punition suffisante, car il a payé 50 000 $ en "argent du sang" à son ex-femme, mère de Lama. Cette somme est inférieure de moitié à celle requise pour un garçon. La loi saoudienne ne prévoit pas l'exécution d'un père ayant tué un enfant ou sa femme, selon al Jazeera.
Trois activistes des Droits de l'Homme saoudiens disent que cet événement avait ému le pays et une campagne Twitter avait commencé avec le slogan "ana Lama", "je suis Lama". On connaît la portée des réseaux sociaux, notamment lors des "Printemps arabes". L'activiste Manal al Sharif a attiré l'attention, lorsqu'en 2011 elle a mis sur le net une vidéo d'elle en train de conduire, défiant ainsi l'interdiction saoudienne (que les femmes conduisent). Aujourd'hui elle est populaire et elle confirme que le mouvement lancé autour de Lama peut prendre de l'ampleur. Le gouvernement est préoccupé et annonce qu'il va installer une hotline 24h/24 pour les appels concernant l'abus d'enfants. Mesure dérisoire devant la situation pédophile du pays, d'autant plus qu'une autre audience sur le même sujet est prévue très prochainement au tribunal, ce qui entraînera sans doute des réactions.
Les ingrédients d'un soulèvement social existent en Arabie saoudite. En décembre 2010, Stephen Schwartz du Centre du Pluralisme islamique m'a expliqué qu'il existait un "conflit entre la jeune génération demandant des réformes et les religieux wahabites"
Dans une interview de radicalIslam.org <http://radicalIslam.org> , Dr Ali Alyami du Centre pour la Démocratie et les Droits de l'Homme en Arabie semble confirmer ce fossé: "il ya une déconnexion progressive du passé, de la religion et une nouvelle perception du monde" dit-il.
Comparé à des ministres au wahabisme pur et dur, le roi Abdallah a des tendances réformistes et il désire une évolution vers le changement. Il y a un mois il a désigné 30 femmes pour participer à la "Shoura", le Conseil, pour soumettre des lois nouvelles à son approbation. Récemment, le gouvernement a autorisé les femmes à travailler en pharmacie.
Un mouvement puissant pour le changement pourrait l'aider à aller plus loin dans les réformes, malgré l'opposition islamiste. L'Occident devrait aider ces activistes saoudiens à maintenir l'élan. En 2009, le brutal assassinat de Neda Soltan a fait d'elle l'emblème de l'opposition iranienne. En 2011, Mohamed Bouaziz s'est immolé en Tunisie déclenchant le "Printemps arabe". En juin 2011, la torture et le meurtre d'un garçon de 13 ans Hamza al Khatib déclencha la guerre civile en Syrie. En 2013, le nom de Lama pourrait devenir synonyme d'un mouvement irrésistible de changement en Arabie Saoudite.
le second article est en anglais et décrit les agissement d'un français vivant en Inde, et marié avec une indienne dont il a 3 enfants, dont une fillette de 3ans et demi, victime de pratiques incestueuses apparemment répétées et très violentes.
Summary of the rape ( incest ?) case in
On June 13, 2012, Ms Suja Jones, an Indian national, wife of French citizen Pascal Mazurier who is employed by the French Consulte in Bangalore, finds her daughter Stella Mazurier, age 3 ½ at the time, complaining about pains in her genitals. Ms Jones takes her to the Baptist Hospital in Bangalore where she is examined : the medical report delivered by the hospital on June 14 confirms that she has been raped and sodomised. The hospital also states that she has been subjected to sexual abuse for probably several months already. The hospital conducted DNA tests. (1)
On June 14, Ms Jones files a case against her husband.
The couple has three children, two boys and this girl.
The police registers the case under article 376 of the Indian Penal Code and arrests Mr Mazurier.
However upon request by the Consul of France in Bangalore, the police authorities decide not to put him in jail, but that the accused will be ‘under the custody’ of the vice consul (2). The reason given for this decision is that it is unclear whether or not Mr Mazurier enjoys diplomatic status ; however, as his job is listed in category C in the nomenclature, it is clear that he has no diplomatic status. Moreover a controversy that took place a year ago between Mr Mazurier and a neighbor has already made this point clear. Anyhow Mr Mazurier remains free from June 15 to June 19.
Demonstrations of human rights groups and women’s rights groups protesting against this situation (3) and demanding that the law prevails, takes place in front of the French consulate on June 18. The demonstrators are dispersed by the police and charged with various offenses.
It is only on June 18 that the French Embassy confirms to the Indian Minitry of Interior that Mr Mazurier do not enjoy diplomatic status (4). On June 19, Mr Mazurier is finally put behind bars.
But after 4 months, he has been freed on bail.(5/1), (5/2), (5/3)
There are questions about the activities of Mr Mazurier during these five days.(6/1)
Two days after he was jailed he writes a cheque for 250 000 Rupees to the vice consul, thus emptying the joint account of the couple, leaving his family with exactly 12 648 Rupees. Will there be an inquiry about how this money was used ?
He also changes the pass word for their joint account in France so that Ms Jones could not access it.
On June 15, two police officers and a social worker submit the girl child to questionning outside the presence of her mother. Two witnesses tell Ms Jones that the child accused her father and described what he had done to her. However the police report is missing from the file given to the judge.(7)
The same day the police takes the girlchild to government hospital Bowring and Lady Curzon : the girl screams while being submitted to the two fingers test.(8/1) Ms Jones said it was like a second rape and that the traumatized girl could not urinate for 8 hours after it. She also described how the child was examined in a delivery room with blood on the walls and in the presence of a half naked woman with her legs wide apart who was actually delivering next to her.
DNA tests are conducted by the hospital outside the presence of any witness ;they prove ‘unconclusive’; it appears that neither the DNA of the father nor the DNA of the girlchild were present in the samples. (8/2)

Whose samples were those ? where have the actual samples gone ?
Moreover, the report from the first hospital, the Bangalore Baptist Hospital, seems not to be in the file anymore.
On June 26, Ms Jones is interrogated by 8 police officers for about 4 hours ; they tell her she fabricated the case. She files a case for harassment.(9)
On September 12, the girlchild is again interrogated by a police officer in ways that lead Ms Jones to file a case at the National Commission for the Protection of the Child ; she stated that an untrained police officer used inappropriate language and gesture.
During the procedure in court, the authorities of the French Consulte in Bangalore have repeatedly consulted with the lawyers of the accused, but never approached victims’s lawyers.
On January 11, Mr Mazurier requested from the Family Court an unsupervised visiting right for himself and his parents ‘in the interest of the children’ (10/1), (10/2), (10/3)
On January 27, he also requests that the children be put in his custody and transfered to France. He filed a case against his wife. (11)
On Jan 28, 2013, the newly appointed Consul of France also consults with Mr Mazurier’s lawyer ; he is introduced to the judge by them ; and ignores the child lawyers. (12/1), (12/2)
Meanwhile, the children’s passports were given to the French Consulat for the renewal of their Indian visas. Although at the time the Consul reassured Ms Jones that the passports will be returned to her, a decision is taken not to give them back, ‘upon written request’ from Mr Mazurier, despite the fact that, after Mr Maazurier’s arrest, the Indian Family court granted Ms Jones the custody of the children (13).
On Feb 6 the Judge in the Family Court refused visiting rights to Mr Mazurier and granted a supervised visit to his parents that took place on Feb 8 in the judge’s office and in the presence of both parties’ lawyers.
On Feb 1, Ms Jones filed a case against her mother-in-law, for complicity (14)
Intimidation has been exerted on Ms Jones, on MD from Bangalore Baptist Hospital who wrote the first report (15) and on a French radio RFI journalist who tried to present both sides of the case : he was threatened by Mr Mazurier’s lawyer in France. Pression was also put on the senior personnel of the radio station(16).
It is to be noted that the domestic personnel of the family who initially testified about Mr Mazurier’s habit to lock himself up in a room with his daughter when Ms Jones was out of the house – including on the day of the last rape on June 13 2012, withdrew their testimonies.
Last week, Mr Mazurier’s lawyers were granted an audience at the Presidential Palace, the Elysée, where they could speak with one of President Hollande’s conseiller .(18)
Mr Mazurier is supported by CRISP(Childrren Rights Initiative for Shared Parenting), a men-only support organisation. One of their representatives was present in Bangalore on Feb 8, and attempted to take pictures of the children when they came out of court, after the supervised visit of their paternal grand parents.
During the past few weeks a defamation campaign against Ms Jones and an all out support campaign for Mr Mazurier took place in the French media. Among other things these articles used a colonial language to stigmatize the Indian Judiciary. (19)
It still continues today ( 20).
President Hollande and an important delegation is due to visit India on Feb 14.(21)
-Mr Mazurier benefitted from unprecendented support from the French authorities.
-An important document is not in the file (testimony of the child)
-Intimidation was exerted on medical doctors and journalist.
-Testimonies of the domestic personnel of the Mazurier family have been withdrawn.
-The question remains of the use of the couple’s money .
(1) Bangalore Baptist Hospital medical doctors filed and signed the requested standard forms after examining Stella on June 13. This includes :
- examination on June 13, report on June 14 sent to Sub Inspector of Police, with copy to Medical Records Department for chart, states : ‘ forcefull sexual penetration assault’, ‘site of accident’ is located at the home.
- Lab services, signed by Sumi Augustine MD and Neena Jones MD, sent for examination ‘samples anal and vaginal swabs’ both ‘positive for spermatozoa’, ‘consistent with penetrative sexual assault on vagina and anus’.
- The Interview Form , ‘in child’s own words’ states that the child ‘disclosed abuse by the father’, location of the incident : ‘home’ ; notes ‘erythema’, ‘redness’, ‘absence of hymen’, ‘gaping anus’, ‘laceration’ ; notes complains by the child : ‘pain, burning sensation in the perineum et anal region’.
- On 16.06 , BBH sent covering letter to Dr Forensic Sciences Lab Karnataka state, in response to High grounds police Station dated 16.06, together with sending evidence collected during examination of Stella on June 13.
- Together with DNA center identification form.
- On 19.06 covering letter together with sending samples from DNA Center to Police Inspector Highgrounds.
(2) ‘Custody’ of the accused granted to vice consul Mr Caumonnat :
A letter from Police Inspector, High Grounds Police Station to Deputy Consul requests Mr Cautonnat ‘to give in writing that you have taken him ( Mr Mazurier) for your custody in fit condition’. A hand written note by Mr Caumonnat acknowledges
that he ‘ received custody’.
(3) 40 activists from teh South Indian Cell for Human Rights (SICHREM) and women’s rights organisations protest on June 18 in front of the French Consulat in Bangalore around 11 am. They demand that Mr Mazurier be normally arrested instead of being in the custody of the Consulat. They are arrested and detained till 6pm. Charges have been pressed against 25 of them.
(4) A Note Verbale n° 1478 by French Consulate Delhi on 18.06 confirms to Ministry of External Affairs New Delhi that Mr Mazurier does not enjoy diplomatic status.
The Ministry of External Affairs forward it to Police Commissaire Karnataka with a covering note.

Senior advocate Pramila Nesargi, counsel for Pascal's wife, Suja Jones ‘it really looks as if police is trying to cover up the case. Prima facie proof is in the Baptist Hospital where the child was first taken", she said.
Nesargi alleged that when Pascal was taken to Bowring Hospital, the necessary samples were not taken in their presence.
(10/1) Mr Mazurier filed an application on January 11 for himself and his parents to be granted visitation rights with his children. However, Ms Jones had earlier secured a restraining order against him.
Mr Mazurier’s parents were allowed to meet their grandchildren in the judge’s chambers on February 8 from 3 pm to 3.30 pm in the presence of both parties’ lawyers.

(11/1) On 27.01, Letter is addressed to Chairman, Karnataka Child Rights Protection Commission by Mr Mazurier ; he makes a ‘request for registering complaint against wife Suja Jones, for child abuse against our 3 minor children’. He states that ‘DNA report from July 6th clearly mentionned that some semen was found on the vaginal and anal swabs from my daughter’s private parts’, but that ‘the semen does not belong to me’. ‘The final police report’ ‘mentions that the DNA profile of the sample blood collected from my daughter is not matching with that of the DNA profile on the stains found on the bed cover, bed sheet’ etc… given by Ms Jones to Police investigation.
He then slanders his wife and concludes that his children are in danger with their mother and that they should be taken away from her :
‘Under these circumstances, the best practical option available before this Honourable commission is to immediately arrange for the transfer of my three children to the country they belong to, that is Republic of France. In their own country, the French Government Children Social Services are available, competent and equipped to take care of the children untill Court reaches a final decision in my case’.

(12/1) Paris, lawyers for Suja Jones ( see note (6)), urged France Foreign Minister Fabius to appoint an official from the Delhi embassy to ensure that the interests of the children were being defended as actively as those of Mazurier.

(13) An exchange of email took place on August 27, between Mr Ashok, Suja Jones’ lawyer and Dominique Causse, then French deputy consul, Bangalore :
Mr Ashok explained why Ms Jones would like a. an acknowledgement that she gave the three children’s passports to the French Consulat in Bangalore for the renewal of their visas; and b. to be reassured that the passports will be returned to her after renewal of visas have been obtained.
Mr Causse ‘ acknowledge(d) receipt of the three passports’ and assured that he ‘will give them back as soon as we receive them from Delhi with the visa’.
And in another email, same day, ‘ we intend to give back the passports to Ms Jones’.
Nevertheless, in a letter dated December 11, 2012, the new Consul Eric Lavertu explains to Ms Jones that her ‘husband objected in writing to the passports being given to’ her. He states that ‘in case of dispute between parents’ the French consular authorities cannot give the passport to either parents, and that to his knowledge no court of justice has made a decision upon it. In wake of Ms Mazurier’s arrest, Ms Jones was granted custody of the children by the Indian Court.
(14) A letter dated August 10 2011, from Mr Mazurier’s mother to her son makes it clear that she knew about ill treatment and abuse on his family, and that she wanted to hide it so that her son would not be held accountable for it.
(15) Doctors from the Bangalore Baptist Hospital were harrassed by the police in December 2012, during two days, so that they come back on their initial report . They complained to the Medical Association, but decided not to take it further after ‘apologies’ were made by the Police Officer.
(16) Intimidation : Mr Mazurier’s lawyer in Paris, Me Pierre-Olivier Sur, attempted to intimidate a correspondant of Radio France International during the first week of December 2012, via telephone calls and emails, threatening him of legal case; the jounalist was requested to take out some parts of his programme and emphasizes other parts so as to reflect Mr Mazurier’s point of view. The journalist had given the same importance to Mr Mazurier’s and to Ms Jones’s respective testimonies. He had sent copies of the programme in advance to both parties. The day before the airing the same kind of threat was sent to the editor in chief and publisher in Paris. The report was nevertheless aired on December 3 and they never followed suit.
(17) Reacting to the reports that French president met with the French lawyers of Pascal Mazurier, Suja Jones told Deccan Herald that her legal counsel in France had written a letter to the French authorities reminding them of their promise to remain neutral in the case and respect the Indian judicial system.

Lawyers for a French consular official who has been charged with raping his three-year-old daughter in India have urged President Francois Hollande to intervene in the high-profile case.The lawyers were due to meet Hollande on Monday.
